The plaintiff/appellant, Ron K. Thompson, an inmate in the custody of the Louisiana Department of Public Safety and Corrections, filed a petition for judicial review of a final agency decision rendered under the Corrections Administrative Remedy Procedure Act. In response thereto, the defendant filed a peremptory exception raising the objection of res judicata. See La.R.S. 13:4231. The district court granted the peremptory exception and dismissed the plaintiff’s petition with prejudice. The plaintiff appeals.
The commissioner’s March 9, 2009, report, adopted by the district court in its April 14, 2009, judgment, thoroughly and adequately discusses the factual and procedural background of this case and provides an excellent analysis of the applicable law. Accordingly, we affirm the district court’s judgment by summary opinion in accordance with Rule 2-16.2A(5) of the Uniform Rules of Louisiana Courts of Appeal. All costs of this appeal are assessed to the plaintiff/appellant, Ron K. Thompson.
