No. 2006 CA 1181.Court of Appeal of Louisiana, First Circuit.
March 23, 2007.
APPEAL FROM THE 19TH JUDICIAL DISTRICT COURT, IN AND FOR THE PARISH OF EAST BATON ROUGE, STATE OF LOUISIANA TRIAL COURT NO. 522,441, HONORABLE, JANICE CLARK JUDGE PRESIDING.
Keith Thompson, Angola, LA, Plaintiff/Appellant In Proper Person.
L. Bruce Dodd, Baton Rouge, LA, Attorney for Appellee, Richard Stalder.
Before: CARTER, C.J., WHIPPLE and McDONALD, JJ.
CARTER, C. J.
Plaintiff/Appellant, Keith Thompson, an inmate in the custody of the Louisiana Department of Public Safety and Corrections, seeks review of the district court judgment dismissing his suit with prejudice.[1] The commissioner’s August 3, 2005 screening report, adopted by the district court as reasons for its judgment, adequately explains the decision. The administrative record indicates that the penalty imposed was a change of housing assignment, which does not constitute a violation of a substantial right of the accused. Cf. Sandin v.Conner, 515 U.S. 472, 486, 115 S.Ct. 2293, 2301, 132 L.Ed.2d 418 (1995). Thus, there exists no ground for reversal or modification of the administrative decision. LSA-R.S. 15:1177A(9).
The district court judgment is affirmed in accordance with Uniform Court of Appeal Rule 2-16.2.A(2), (5) and (6). Costs of this appeal are assessed to plaintiff/appellant, Keith Thompson.
