[1] The defendant, John E. Kirsch, was convicted of violating LSA-R.S. 40:966(C)possession of a controlled substance identified as marijuana and sentence to six months in parish prison. He appealed to this court to review the record for errors patent and for sufficiency of the evidence to support the conviction. We affirm the conviction and sentence.West Page 1296
[2] The defendant was convicted of a misdemeanor and therefore was not entitled to a jury trial or an appeal. See LSA-Const. 1974, art. 1, sec. 17, and art. 5, sec. 10(A). The proper method for review is by writ application. LSA-C.Cr.P. 912.1(C). In the interest of judicial economy, however, this court has reviewed these matters in the past and will consider this matter now. Se State v. Hansan, 472 So.2d 142 (5th Cir. 1985).
