[2] DIXON and DENNIS, JJ., are of the opinion the writ should be granted for the reason that the exception of prematurity should have been decided (instead of referred to merits) (C.C.P. 929) and sustained. [3] CALOGERO, J., is of the opinion the writ should be granted.
