Bobby L. Forrest, Baton Rouge, for appellants.
Calvin C. Fayard, Jr., Denham Springs, for appellee.
Before ELLIS, CHIASSON and PONDER, JJ.
CHIASSON, Judge.
[1] This matter is before this Court on a Motion to Dismiss Appeal filed by Alex Theriot, Jr., Inc., plaintiff-appellee. On December 10, 1976, judgment was rendered by the District Court dismissing the peremptory exceptions of prescription and no right of action and the declinatory exceptions of lis pendens,West Page 1265
present case. The allegedly indispensable party is a party to the present suit. There is no indication as to what the irreparable harm to the appellants would be with regard to their reconventional demand. There has been no showing of irreparable injury by the appellants and the judgment of the District Court is therefore not appealable.
[11] For the above reasons, the appeal is dismissed and the case remanded to the District Court for further proceedings. The appellants are to pay all cost of this appeal. [12] APPEAL DISMISSED AND CASE REMANDED.105 La. 522 Louisiana Supreme Court R. M. Walmsley & Co. and S. P. Walmsley…
